| 1. The booking shall be between the person signing the Booking Form (guest) and Robert H. Lyle, owner of Sunny Spirit. |
| 2. The guest certifies that he or she is authorised to sign the Booking Form on behalf of all persons who will occupy the property during the period for which he/she has booked and that they are all, apart from minors, aware of the Booking Conditions. The maximum number of guests who may occupy the house and the surrounding grounds is six. Exceeding this number constitutes a breach of contract and Robert H. Lyle has a right to terminate the booking forthwith and all monies paid by the guest will be forfeit. |
| 3. No booking will be accepted unless the Booking Form has been filled in by the guest and accepted by Robert H. Lyle on our Acceptance Form. All contracts will be deemed to have been made in Cornwall and are in accordance with and subject to English law. |
| 4. This property is hired on the understanding that the accommodation is for holiday use only and that no right to remain in the accommodation exists for the guest or anyone in the guest's party. |
| 5. CANCELLATION: We are unable to provide cancellation insurance and this is NOT included in the rental. Therefore we strongly recommend that Holiday Insurance is taken out independently by the guest as once a deposit is taken the full balance will become payable on the due date. |
| 6. FINAL PAYMENT: Final payment set out in the Booking Form is due four weeks before a holiday commences and this is shown as the due date on the Acceptance form. No further reminders will be sent. Non-payment by the due date will be treated as a cancellation. The guest's initial payment will be forfeit and he/she remains liable for the full amount of the final payment. We will then seek to re-let the property without further reference to you. In the event of a re-let, credit will be given to the guest for the amount of rental achieved on the re-letting, less any reasonable administrative or professional costs incurred in connection with such re-letting. Lyle cannot be held responsible for postal delays or Internet outages. |
| 7. If a booking is made less than four weeks before the commencement of the holiday, the full rent is due at the time of booking. |
| 8. If for any reason Sunny Spirit becomes unavailable, Robert H. Lyle will refund all monies paid in full and will be under no further liability towards you. |
| 9. No pets are permitted in Sunny Spirit. Any guest who takes a pet into Sunny Spirit without permission in writing is in breach of Contract and Robert H. Lyle has the right to terminate the booking forthwith and to retain all monies paid by guest. |
| 10. Sunny Spirit is available from 3:00 p.m. on the Saturday beginning your holiday until 10:00 a.m. the Saturday ending your holiday as shown on the Acceptance Form. These times must be strictly adhered to except by special arrangement in writing with Robert H. Lyle. |
| 11. Care must be taken of Sunny Spirit and it must be left by the guest in a clean and tidy state and all furniture returned to the place in which it was found on entry. Robert H. Lyle and the caretakers (The Marina Hotel) reserve the right to reasonable access during the period of hire. |
| 12. Guest must report to the Caretaker any damage or breakages that occur during their stay and appropriate charge will be made for repair or replacement. |
| 13. Guest will properly supervise at all times any infants or minors who will occupy Sunny Spirit with the guest or be invited into Sunny Spirit by the guest or any other adult in the guest's party. |
| 14. Sunny Spirit is fully equipped with sheets, duvet covers, pillowcases, towels and tea towels. |
| 15. In spite of the care and precautions taken, it is possible that the guest could have grounds for complaint about Sunny Spirit. Any complaint must be taken up immediately in full with the Caretaker or Robert H. Lyle. The Caretaker (Marina Hotel) is not a party to the contract between Robert H. Lyle and the guest. In the event that disputes cannot be resolved, the matter will be referred to the relevant local Cornish Tourist Board or other suitable representative whose decision shall be final and binding upon both Robert H. Lyle and the guest and his/her party. Any complaints that do arise must be taken up with Robert H. Lyle, the Marina Hotels Lets prior to the guests departure from the premises and in any event as soon as reasonably practicable after the cause for complaint has arisen. |
| 16. Whilst representations both verbal and visual contained on the website are made in good faith and carefully scrutinised, neither such verbal and visual representations contained on the website form part of the contract. No warranty or representation is given as to the state of Sunny Spirit. The colours shown on the website may not be accurate. This may be due to technical print reason, changes of décor or furnishings or fabrics or seasonal variations. |
| 17. Robert H. Lyle cannot be held to account for any holiday fairs, fetes, events or festivals occurring during the letting season nor building works in the vicinity or neighbouring properties. |
| 18. The use of amenities provided by Robert H. Lyle, such as barbecue, outdoor furniture, etc. is entirely at the guest's and his/her parties risk and no responsibility can be accepted for any injuries to persons or loss or damage to any belongings of persons who use them save as provided in the next paragraph. |
| 19. Robert H. Lyle does not accept liability for any act, neglect or default on the part of any other person not within his employ or otherwise under his control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the tenants or any other person may suffer or incur arising out of, or in any way connected with the letting. In addition, Robert H. Lyle accepts no liability for loss of or damage to the tenants' possessions on Robert H. Lyle's property or land. |
